Our privacy policy will help you understand what information we collect for Alcohol Assistant, how we uses it, and what choices you have. We built the Alcohol Assistant app as a free/paid app. This SERVICE is provided by Alcohol Assistant at no cost unless you subscribe and is intended for use as is. End User License Agreement

Introduction

This End User License Agreement ("EULA") is a legal agreement between you (the user) and Triad ATS (the company), governing your use of the "Alcohol Assistant" mobile application, including any updates, supplements, and related services provided by Alcohol Assistant. By accessing or using Alcohol Assistant, you acknowledge that you have read, understood, and agree to be bound by this EULA. If you do not agree to these terms, you may not access or use Alcohol Assistant.

App Use

License Grant: Triad ATS grants you a limited, non-exclusive, non-transferable, revocable license to use Alcohol Assistant on your personal mobile device for your own personal, non-commercial use.Restrictions: You may not:
Modify, adapt, translate, or create derivative works of Alcohol Assistant.
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of Alcohol Assistant.
Rent, lease, lend, sell, distribute, or sublicense Alcohol Assistant to any third party.
Use Alcohol Assistant for any illegal or unauthorized purpose.
Use Alcohol Assistant in any manner that could damage, disable, overburden, or impair the functioning of the Alcohol Assistant app or any server, network, or other equipment connected to or used to provide the Alcohol Assistant app.
Interfere with or disrupt the integrity or performance of Alcohol Assistant.
Use any robot, spider, crawler, scraper, or other automated means to access Alcohol Assistant.Personal Responsibility: While Alcohol Assistant is an app for storing and easily accessing drinks, it is not responsible for the misuse of drinks by the user. With this being said Alcohol Assistant should be used by someone of drinking age only. And please drink responsibly.

Subscription Services

Subscription Options: Alcohol Assistant offers subscription options that provide access to premium features, such as [list premium features, e.g., ad-free experience, searchable content, personalized sharing].Payment and Billing: If you choose to subscribe, you will be charged the applicable subscription fee to your chosen payment method. Subscription fees are typically recurring, meaning they automatically renew upon the renewal date.Cancellation: You may cancel your subscription at any time through your device's app store settings. However, you will not receive a refund for any portion of the subscription fee already paid.Free Tier: If a free tier is offered, it will be subject to the same terms and conditions.

Data Sharing and Privacy

Data Collection: Alcohol Assistant may collect certain information about you and your use of the App, such as your device information, usage data, and location information. For more information on our data collection and privacy practices, please refer to our Privacy Policy, which is incorporated into this EULA by reference. While Alcohol Assistant does collect data in the form of drinks for your account, access to that data is your responsibility and we can not be held responsible for missing or removal of your data.Sharing Drink Information:
Alcohol Assistant may allow you to share drink information with other verified users of the App.
You are solely responsible for the accuracy and appropriateness of the drink information you share.
Triad ATS is not responsible for any misuse or unauthorized access to the drink information you share.

Intellectual Property

Alcohol Assistant and all related intellectual property rights, including but not limited to trademarks, copyrights, and patents, are owned by Triad ATS or its licensors. This EULA grants you no rights to any such intellectual property.

Disclaimer of Warranties

ALCOHOL ASSISTANT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TRIAD ATS DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ALCOHOL ASSISTANT OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

IN NO EVENT SHALL TRIAD ATS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THIS EULA OR THE USE OF OR INABILITY TO USE ALCOHOL ASSISTANT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT TRIAD ATS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification

You agree to indemnify and hold harmless Triad ATS and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including attorneys' fees) arising out of or relating to your use of Alcohol Assistant, your violation of this EULA, or your infringement of any third party's rights.

Governing Law

This EULA shall be governed by and constructed in accordance with the laws of the State of NC, without regard to its conflict of law principles.

Dispute Resolution

Any dispute arising out of or relating to this EULA shall be resolved through binding arbitration in NC, in accordance with the rules of the American Arbitration Association. Each party shall bear their own costs of arbitration.

Changes to this EULA

TRIAD ATS may revise this EULA from time to time. The most current version of the EULA will always be available on Alcohol Assistant. By continuing to use Alcohol Assistant after any such revisions, you agree to be bound by the revised EULA.
